Eyes and Ears Ltd (“Eyes and Ears”, “we”, “our”, or “us”) is committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 2020 and other applicable laws.

This Privacy Policy explains how we collect, use, store, disclose and protect personal information in the course of our business as a film and content production company, and the rights you have in relation to your personal information.

"Personal information" means any information about an identifiable natural person.

We may update this Privacy Policy from time to time.  The most current version will be available on our website.

 

1. What Personal Information We Collect

The personal information we collect may include your name, date of birth, addresses, email address, telephone numbers, gender, other demographic information; information on your use of our services or facilities; and any other information provided by you in connection with, or specifically related to your communications with us, or your use of our services or facilities. 

Due to the nature of our work, we will also create and use Production Materials & Media Content in which individuals are identifiable (see section 4). 

We may collect personal information about cast, crew, contributor, clients and/or their representatives or personnel, information relating to the services or work to be performed, project briefs, payment and invoicing information, contact details, and information about your company or business generally.

 

2. How We Collect Personal Information

We may collect personal information in a variety of ways, including when:

  • You engage us for production services

  • You apply for employment or contract work

  • You participate in a production (as cast, crew, contributor, location provider, or client)

  • You correspond with us by phone, email, meetings, or social media

  • You complete forms, agreements, or surveys

  • You subscribe to marketing communications

  • You visit our website (see Website Analytics, below).

Third-Party Sources

We may also collect personal information from:

  • Casting platforms or talent agents

  • Recruitment providers

  • Clients

  • Production partners

  • Publicly available sources

  • Referees (with your knowledge)

Website Analytics & Cookies

Our website may use cookies and third-party analytics tools (such as Google Analytics or social media tracking pixels) to understand website traffic and improve user experience.  

A cookie is a small text file that our website may place on your device as a tool to remember your preferences. These technologies help us better understand user behaviour, tell us which parts of our website people have visited, and facilitate and measure the effectiveness of our services. 

Pixel tags enable us to send email messages in a format users can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to you.

These tools may collect information about your device, IP address, browser settings and browsing behaviour, time-zone, operating system and other technology on the device you use to access our website.

You may disable or clear cookies through your browser settings.  Refer to your browser's help function for information on how to do this. 

 

3. How We Use Personal Information

The personal information that we collect may be used for any of the following purposes: 

(a)     To assist us and our personnel to provide you with services or facilities . 

(b)    To improve, tailor, or personalise your experience of those services, including your use of our website

(c)     To positively confirm your identity. This is to avoid inappropriate release or use of your information. 

(d)    To respond to correspondence or to provide you with information that you have requested. 

(e)     To process payments received by or made by Eyes and Ears. 

(f)        To respond to your requests, enquiries or feedback. 

(g)     To provide you with information about our work, news, services or facilities, or other advertisements that we consider may be of interest to you. 

(h)     To comply with relevant laws and regulations. 

(i)        To carry out activities connected with the running of our business or operations such as personnel training, or testing and maintenance of computer and other systems. 

(j)        For any specific purpose which we notify you of at the time your personal information is collected. 

(k)     For general administrative and business purposes. 

(l)        To conduct research and statistical analysis to improve our service offerings.

(m) To ensure we can carry out our business and services in a way that respects and provides appropriate cultural support.

 

Marketing Communications

We may use your personal information for the purposes of sending you marketing communications and newsletters.

If you receive marketing communications from us, you may opt out at any time by using the unsubscribe function or contacting us directly.

 

4. Production Materials & Media Content

As part of our production activities, we may collect and create visual and audio recordings in which individuals are identifiable ("Media Content").  As part of that production process, we may collect, create, and process information such as (for instance) casting submissions and self-tapes, talent release forms, location release forms, behind-the-scenes or promotional footage, other promotional collateral, testimonials or case studies ("Production Materials").

Such Production Materials & Media Content may be:

  • Used in commercial productions

  • Distributed across television, digital, cinema, or social platforms

  • Shared with clients and agencies

  • Archived for legal, contractual, or portfolio purposes

These uses are typically governed by contractual agreements, release forms, or production agreements.  This Privacy Policy applies except to the extent provided for in those more specific agreements.

 

5. Sharing your Information

We may disclose personal information to:

  • Clients commissioning productions

  • Production partners, agencies and collaborators

  • Contractors and crew

  • Cloud storage and technology providers that support us, including hosting or maintaining any underlying IT system or data centre that we use

  • Accountants, insurers and professional advisers

  • Regulatory authorities where required by law

  • Law enforcement agencies (including sharing CCTV footage where appropriate)

  • Any person you authorise us to disclose information to

We take reasonable steps to ensure that third-party service providers protect personal information appropriately.

We may also disclose your personal information if necessary in connection with: 

  • detecting, preventing, or addressing fraud, security, or technical issues, or other suspected illegality or security issues;

  • enforcing, protecting, or defending our rights, property or safety, or that of third parties, including enforcing our privacy policy and any contract we have entered into with you.

Aggregated or de-identified information

We may disclose or use aggregated de-identified information for any purpose. For example, we may share aggregated de-identified information with the general public or any partners or stakeholders.

 

6. Overseas Disclosure & Cloud Storage

We may store or process personal information using reputable third-party cloud service providers located in New Zealand or overseas.

Where personal information is transferred outside New Zealand, we take reasonable steps to ensure it is protected by safeguards comparable to those required under the Privacy Act 2020.

 

7. Data Security

We take reasonable steps to protect personal information against loss, unauthorised access, misuse, disclosure or alteration.

These steps may include:

  • Secure cloud storage systems

  • Password protection and access controls

  • Confidentiality obligations for staff and contractors

  • Secure premises and CCTV monitoring

  • Secure data transfer methods where appropriate 


8. Retention of Personal Information

We retain personal information only for as long as necessary to fulfil the purpose for which it was collected or as required by law.

Production Materials, including footage, may be archived for contractual, legal, portfolio or historical purposes.

CCTV footage is retained for a limited period unless required for investigation or legal proceedings.

 

9. CCTV & Surveillance

CCTV operates at our premises for safety and security purposes.

The purposes of CCTV include:

  • Protecting staff, clients, crew and visitors

  • Protecting property and assets

  • Assisting law enforcement where required

Individuals identifiable in CCTV footage may request access in accordance with the Privacy Act 2020.

Requests should include:

  • Date and approximate time of footage

  • Description of the event

  • Reason for request

Requests will be processed within 20 working days unless otherwise agreed.

  

10. Accessing and Correcting Your Information

You have the right to request confirmation of whether we hold personal information about you and to request access to that information.

You may also request correction of your personal information.

We may require proof of identity before releasing information.

Your rights are subject to the procedures and grounds for refusal set out in the Privacy Act 2020.


11. Privacy Breaches

If we experience a privacy breach that is likely to cause serious harm, we will notify affected individuals and report the breach to the Office of the Privacy Commissioner in accordance with the Privacy Act 2020.

  • Include you in productions

  • Provide requested services
